Please read these terms of services carefully before using our service.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these terms:

• Application means the software program/app provided by the company downloaded by you.
• Application Store means the digital distribution service operated and developed by Apple Inc. Apple App Store in which the application has been downloaded.
• Country refers to: Germany
• Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to an app(Developed by - Ishtiak Ahmed & Kazi Munshimun Nabi)
• Device means any device that can access the service such as an iPhone or a iPad.
• Service refers to the Application itself.
• Terms of services (also referred as “Terms”) mean these terms and conditions that form the entire agreement between you and the company regarding the use of the service.
• You means the individual accessing or using the service, or the company, or other legal entity on behalf of which such individual is accessing or using the service, as applicable.

Acknowledgment

These are the terms of services governing the use of this service and the agreement that operates between you and the company. These terms set out the rights and obligations of all users regarding the use of the Service. Your access to and use of the service is conditioned on your acceptance of and compliance with these terms. These terms apply to all users and others who access or use the service. By accessing or using the service you agree to be bound by these terms. If you disagree with any part of these terms then you must not access the service.

Age Requirement

You represent that you are over the age of 13 or 16 in the EEA or older to install or to use our app/service. Keep in mind, if you are 13+ or 16+ in the EEA but not 18+ years of age you need permission from your parents/legal guardians who can review the terms for you, discuss any questions you might have, and install the app for you. In the case of year 13+ or but not 18+, As a parent or legal guardians you must grant your child permission to download/use/access the app and you as a parent or gruardian agree to the terms of services on behalf of your child. You as a parent or guardian are responsible for exercising supervision over your children’s app usage activities NOT us/app provider. If you do not agree to this terms please do NOT let your child download/use/access the app or any associated app features.

Restricted Use Limitations

You as a user of the app must not sell, distribute, lease, sublicense of any kind or in any way provide any rights to app or use the app for the benefit of any third party organisation. Unless expressly authorized by us though proper documentataion or permitted under the applicable mobile platform terms such as app store or google play, you are totally prohibited from distributing this app available over a internet/network/any applicable mobile platform where it might be installed or used by certain users or any users. You must agree that you as individual or your company must not use some bot/trojan horse/spider/spam or other automatic or manual device or process to interfere/intervene or make an effort to achieve completly or parcially to interfere with the proper working of the app.

You as individual or your company must not break or make an effort to achieve completly or parcially to break the security of the app. You must not partially or completly change, decompile, alter, make partial or minor modification, reverse-engineer, disassemble, or otherwise tamper with our app by automated or manual process or device, or attempt to do so for any particual reason or by any particular means. You must not try to access, reverse engineer, alter, violate the source code of any our app in any way through manual and automated process. You must not use any debugging or interceptor tools to alter/change/detect information flow of our app or any portions thereof. We are only responsible for enhancements or modifications or upgrades to the app and the app remain the sole property of us.

Apps Update

We solely reserve the right to add/remove/alter/modify/enhance the features/partial feature/entire functionalities/partial functionalities of the app. To provide bug free app, We may/may not require to update the app on your mobile device. You must agree that any obligation we must have to support previous versions of the our app may be ended upon the availability of new app updates/versions of the app. You acknowledge and agree that we have no obligation to make available to you any updates/versions of the our app even if the app can have user interface glices and bugs.

Access

As a user of the app, you are solely responsible for any costs you create to access the app from your device such as internet costs/data volume cost etc. You acknowledge and agree that we can not guaranty that our app can be accessed on all devices or all network provider’s plans. We are also not obliged that the our apps will be available in all languages.

Purchase Subscriptions

You can purchase some of our app with subscription plan, and our apps may provide different levels of subscription based on our application idea(usually free or premium). Payment/billing for a subscription plan (e.g. monthly, yearly, lifetime) is controlled by mobile platform owner (e.g. Apple)’s billing provider. In some case, we will offer our app user a free trial of a our premium subscription plan for a limited period of time(e.g. 7 days/1 month). In this case, you can always cancel a free-trial subscription at any time using the subscription setting in your iTunes account. However, If you choose free trial which is automatically renew will be renewed automatically as a paid subscription unless you cancel manually before the end of the free-trial subscription period. Please review the mobile platform owner’s terms in this regard before taking subscription plan. You can cancel your subscription plan at any time by following the Apple App Store instructions using the subscription settings in your iTunes account.

Cancel Subscriptions

All type of premium subscription plan cancellations will be taken to effect starting at the end of the current billing period. (e.g. If you have a monthly premium subscription plan that will begin on the first of the month but cancel mid-month, your cancellation will be effective as of the end of that month.) You may ackonledge that there would be no refund or refunds on premium subscription plan once the charge has gone through for the billing period.

Purchase With One Time Fee

Some of our app can be used by one time purchase (no recurring subscription and no recurring billing). In this case, Billing for such purchases is handled by a mobile platform owner (e.g. Apple). We don’t have any inflence on mobile platform owner (e.g. Apple)’s billing provider. EU residents have a right to cancel online purchases within 14 days. You must agree that if you are EU resident and purchase the app from a mobile platform owner (e.g. Apple), you may not be able to cancel your order or obtain a refund from mobile platform owner (e.g. Apple). Please review the mobile platform owner’s terms in this regard before purchase. You may uninstall our one time paid application at any time. All purchases of paid applications are non-refundable.

Automatic Renewal

All type of paid subscriptions of our app are considered as auto-renewing subscriptions. Automatic renewal (auto-renewal) means your premium subscription will be conveniently renewed at the end of your monthly or annual subscription term. All subscriptions are set to automatically renew, unless you cancel the auto-renewal before the next renewal date. Mentioned subscription amount will be charged for the subscription period upon activation of your premium subscription plan and submission of your payment information or, if applicable, at the end of your free trial period of the premium subscription plan, if you have not canceled/forgot to cancel at least 3 days in advance of the expiration of the trial period. You must also agree that automatic (recurring) billing will be paid from your account and account should have avaialble balace to do so. If it is not the case, You will be billed at the then-current applicable subscription price plus any applicable taxes/fees. All types of payments for renewal premium subscriptions are done using the same billing cycle as your current subscription plan. Your subscription plan which is auto renewal and the billing of your account will continue indefinitely until it is cancelled by you.

Security

Our app may not be 100% secure like any other apps. The app may be exposed to jail break, unauthorized attempt to crack the security, unauthorized attempt to access, interfere, interception, corruption, partially and/or fully damage, partially and/or fully misuse and in this case it is not considered as 100% secure app. You must accept that the responsibility for such security risks and any damage resulting therefrom. You must also agree that we would not be liable for any unauthorized access to your mobile device.

Remove/Uninstall the app

You can remove/uninstall the app at any time and it totally depends on your device capability. We suggest to use application manager provided with your device to uninstall and remove the app. Please don’t use any third party application removal softwares/services to remove/uninstall our app. Keep in mind, if you have a paid subscription/trial subscription than auto renewal to the app, uninstalling will not cancel your subscription plan as well as recurring payments. Please cancel subscription plan (if you have any) before uninstall the application.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company’s provider makes any representation or warranty of any kind, express or implied:

• (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon;
• (ii) that the Service will be uninterrupted or error-free;
• (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or
• (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components. Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Privacy Policy

Our privacy policy describes our policies and procedures on the collection, use and disclosure of your personal information when you use the application and tells you about your privacy rights and how the law protects you. Please read our privacy policy carefully before using our service.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this terms and your use of the service. Your use of the application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If you have any concern or dispute about the service, You agree to first try to resolve the dispute informally by contacting the company.

For European Union (EU) Users

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Legal Compliance

You represent and warrant that

• (i) you are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and
• (ii) you are not listed on any United States government list of prohibited or restricted parties.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these terms. Upon termination, your right to use the service will cease immediately.

Changes to These Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these terms at any time. By continuing to access or use our service become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the service.

All contents, logos and service marks displayed on the app are our property. You are not permitted to use these marks without our prior written consent.
